1. Introduction

These Terms of Use ("Terms") govern your access to and use of the FutWiser mobile application ("App") operated by NORDIVUS OÜ ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

FutWiser is a football analytics and statistics application that provides match predictions, live scores, team and player statistics, and AI-powered analysis. The App is intended for informational and entertainment purposes only.

FutWiser does not offer, promote, or facilitate real-money gambling or betting of any kind. The App solely provides statistical data and analytical content.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Account Registration

To access certain features of the App, you must create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security and confidentiality of your login credentials.
Accept responsibility for all activities that occur under your account.
Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate or if you violate these Terms.

5. Subscriptions and Payments

FutWiser offers auto-renewable subscription plans to access premium features. By subscribing, you agree to the following terms:

Subscription Features:

Basic: Ad-free experience, basic statistics (excluding corner/card data), access to all matches.
Pro: All Basic features, daily AI-powered predictions, advanced AI analysis.
Elite: All Pro features, corner and card statistics, VIP customer support.

Billing and Renewal:

Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions automatically renew at the end of each billing period (weekly, monthly, or yearly) unless cancelled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
Prices are in EUR and may vary by region based on App Store or Google Play pricing.

Cancellation:

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.
No refunds are provided for partial subscription periods.

Free Trial:

If a free trial is offered, you will not be charged during the trial period.
At the end of the free trial, the subscription will automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends.
Any unused portion of a free trial is forfeited upon purchasing a subscription.

6. User Conduct

When using the App, you agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to the App, servers, or databases.
Reverse engineer, decompile, or disassemble any part of the App.
Reproduce, distribute, or commercially exploit the App's content without permission.
Use automated scripts or bots to access the App or extract data.
Interfere with or disrupt the operation of the App or its infrastructure.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, data, software, and design — are the exclusive property of NORDIVUS OÜ or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Disclaimer of Warranties

The App and its content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee:

The accuracy, completeness, or reliability of match predictions, statistics, or analysis.
Uninterrupted or error-free operation of the App.
That the App will meet your specific requirements or expectations.

Match predictions and statistics are for informational purposes only and should not be relied upon as the sole basis for any decision.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NORDIVUS OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Third-Party Services

The App may integrate with or contain links to third-party services (e.g., RevenueCat, Firebase, Apple App Store, Google Play Store). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is subject to their respective terms and policies.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Estonia.

Kullanım Koşulları

1. Giriş

Bu Kullanım Koşulları ("Koşullar"), NORDIVUS OÜ ("biz", "bizim" veya "bize") tarafından işletilen FutWiser mobil uygulamasına ("Uygulama") erişiminizi ve kullanımınızı düzenlemektedir. Uygulamayı indirerek, yükleyerek veya kullanarak bu Koşullar'a bağlı olmayı kabul etmiş olursunuz. Bu Koşullar'ı kabul etmiyorsanız Uygulamayı kullanmayın.

2. Hizmet Tanımı

FutWiser, maç tahminleri, canlı skorlar, takım ve oyuncu istatistikleri ile yapay zeka destekli analizler sunan bir futbol analiz ve istatistik uygulamasıdır. Uygulama yalnızca bilgilendirme ve eğlence amaçlıdır.

FutWiser hiçbir şekilde gerçek parayla bahis oynama, bahis önerme veya bahis kolaylaştırma hizmeti sunmamaktadır. Uygulama yalnızca istatistiksel veri ve analitik içerik sağlar.

3. Uygunluk

Uygulamayı kullanabilmek için en az 13 yaşında olmanız gerekmektedir. Uygulamayı kullanarak bu yaş şartını karşıladığınızı beyan ve garanti etmiş olursunuz. 18 yaşından küçükseniz bu Koşullar'ı bir ebeveyn veya vasiyle birlikte incelemeniz gerekmektedir.

4. Hesap Kaydı

Uygulamanın belirli özelliklerine erişmek için bir hesap oluşturmanız gerekmektedir. Aşağıdakileri kabul etmiş olursunuz:

Kayıt sırasında doğru, güncel ve eksiksiz bilgi sağlamak.
Giriş bilgilerinizin güvenliğini ve gizliliğini korumak.
Hesabınız altında gerçekleşen tüm faaliyetlerin sorumluluğunu kabul etmek.
Hesabınızın yetkisiz kullanımını derhal bize bildirmek.

Sağlanan bilgilerin yanlış olduğu tespit edilirse veya bu Koşullar'ı ihlal ederseniz hesabınızı askıya alma veya sonlandırma hakkını saklı tutarız.

5. Abonelikler ve Ödemeler

FutWiser, premium özelliklere erişim için otomatik yenilenen abonelik planları sunmaktadır. Abone olarak aşağıdaki koşulları kabul etmiş olursunuz:

Abonelik Özellikleri:

Basic: Reklamsız deneyim, temel istatistikler (korner/kart verileri hariç), tüm maçlara erişim.
Pro: Tüm Basic özellikler, günlük yapay zeka destekli tahminler, gelişmiş yapay zeka analizi.
Elite: Tüm Pro özellikler, korner ve kart istatistikleri, VIP müşteri desteği.

Faturalandırma ve Yenileme:

Ödeme, satın alma onayında Apple Kimliğinize veya Google Play hesabınıza faturalandırılır.
Abonelikler, mevcut dönemin bitiminden en az 24 saat önce iptal edilmedikçe her faturalandırma döneminin (haftalık, aylık veya yıllık) sonunda otomatik olarak yenilenir.
Hesabınız, mevcut dönemin bitiminden 24 saat önceye kadar seçilen planın ücretiyle yenileme için faturalandırılacaktır.
Fiyatlar EUR cinsindendir ve App Store veya Google Play fiyatlandırmasına göre bölgeye göre değişiklik gösterebilir.

İptal:

Aboneliğinizi istediğiniz zaman Apple App Store veya Google Play Store hesap ayarlarınızdan iptal edebilirsiniz.
İptal, mevcut faturalandırma döneminin sonunda geçerli olur. Ödenen dönemin sonuna kadar premium özelliklere erişiminiz devam eder.
Kısmi abonelik dönemleri için iade yapılmaz.

Ücretsiz Deneme:

Ücretsiz deneme sunulması halinde, deneme süresince sizden ücret alınmaz.
Ücretsiz deneme süresinin sonunda, deneme bitmeden en az 24 saat önce iptal edilmedikçe abonelik otomatik olarak ücretli aboneliğe dönüşür.
Bir abonelik satın alındığında ücretsiz denemenin kullanılmayan kısmı geçersiz olur.

6. Kullanıcı Davranışı

Uygulamayı kullanırken aşağıdakileri yapmamayı kabul edersiniz:

Uygulamayı herhangi bir yasadışı amaçla veya yürürlükteki yasalara aykırı şekilde kullanmak.
Uygulamaya, sunuculara veya veritabanlarına yetkisiz erişim sağlamaya çalışmak.
Uygulamanın herhangi bir bölümünü tersine mühendislik yapmak, kaynak koda dönüştürmek veya parçalara ayırmak.
Uygulamanın içeriğini izinsiz olarak çoğaltmak, dağıtmak veya ticari olarak kullanmak.
Uygulamaya erişmek veya veri çıkarmak için otomatik komut dosyaları veya botlar kullanmak.
Uygulamanın veya altyapısının çalışmasını engellemek veya bozmak.

7. Fikri Mülkiyet

Uygulamanın tüm içeriği, özellikleri ve işlevselliği — metin, grafikler, logolar, simgeler, veriler, yazılım ve tasarım dahil ancak bunlarla sınırlı olmamak üzere — NORDIVUS OÜ'nün veya lisans verenlerinin münhasır mülkiyetindedir ve fikri mülkiyet yasalarıyla korunmaktadır. Önceden yazılı iznimiz olmadan Uygulamayı kopyalayamaz, değiştiremez, dağıtamaz veya Uygulamaya dayalı türev eserler oluşturamazsınız.

8. Garanti Reddi

Uygulama ve içeriği, açık veya zımni herhangi bir garanti olmaksızın "OLDUĞU GİBİ" ve "MEVCUT OLDUĞU ŞEKİLDE" sunulmaktadır. Aşağıdakileri garanti etmiyoruz:

Maç tahminlerinin, istatistiklerin veya analizlerin doğruluğu, eksiksizliği veya güvenilirliği.
Uygulamanın kesintisiz veya hatasız çalışması.
Uygulamanın özel gereksinimlerinizi veya beklentilerinizi karşılayacağı.

Maç tahminleri ve istatistikler yalnızca bilgilendirme amaçlıdır ve herhangi bir karar için tek dayanak olarak kullanılmamalıdır.

9. Sorumluluk Sınırlaması

Yürürlükteki yasaların izin verdiği azami ölçüde, NORDIVUS OÜ, Uygulamayı kullanımınızdan kaynaklanan veya bununla ilgili herhangi bir dolaylı, arızi, özel, sonuç olarak ortaya çıkan veya cezai zarardan sorumlu olmayacaktır. Toplam sorumluluğumuz, talebin öncesindeki 12 ay içinde Uygulama için ödediğiniz tutarı aşmayacaktır.

10. Üçüncü Taraf Hizmetler

Uygulama, üçüncü taraf hizmetlerle (örn. RevenueCat, Firebase, Apple App Store, Google Play Store) entegre olabilir veya bunlara bağlantılar içerebilir. Üçüncü taraf hizmetlerin içeriğinden, gizlilik uygulamalarından veya koşullarından sorumlu değiliz. Bu tür hizmetlerin kullanımınız kendi koşullarına ve politikalarına tabidir.

11. Gizlilik

Uygulamayı kullanımınız ayrıca kişisel bilgilerinizi nasıl topladığımızı, kullandığımızı ve koruduğumuzu açıklayan Gizlilik Politikamız tarafından da yönetilmektedir. Uygulamayı kullanarak, Gizlilik Politikasında açıklanan veri uygulamalarımıza onay vermiş olursunuz.

12. Fesih

Uygulamaya erişiminizi herhangi bir zamanda, sebep göstererek veya göstermeksizin, bildirimde bulunarak veya bulunmaksızın askıya alabilir veya sonlandırabiliriz. Fesih üzerine Uygulamayı kullanma hakkınız derhal sona erer. Doğası gereği fesihten sonra da geçerli olması gereken hükümler (fikri mülkiyet hakları, garanti redleri ve sorumluluk sınırlamaları dahil) yürürlükte kalmaya devam edecektir.

13. Bu Koşullardaki Değişiklikler

Bu Koşullar'ı herhangi bir zamanda değiştirme hakkını saklı tutarız. Değişiklikler, güncellenmiş Koşullar'ın Uygulama içinde veya web sitemizde yayınlanmasıyla yürürlüğe girecektir. Herhangi bir değişiklikten sonra Uygulamayı kullanmaya devam etmeniz, değiştirilmiş Koşullar'ı kabul ettiğiniz anlamına gelir.

14. Uygulanacak Hukuk

Bu Koşullar, kanunlar ihtilafı hükümleri dikkate alınmaksızın Estonya Cumhuriyeti yasalarına tabi olacak ve buna göre yorumlanacaktır. Bu Koşullar'dan doğan her türlü uyuşmazlık Estonya'daki mahkemelerin münhasır yargı yetkisine tabi olacaktır.
