1. Introduction

These Terms of Use ("Terms") govern your access to and use of the FutWiser mobile application ("App") operated by NORDIVUS OÜ ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

FutWiser is a football analytics and statistics application that provides match predictions, live scores, team and player statistics, and AI-powered analysis. The App is intended for informational and entertainment purposes only.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate or if you violate these Terms.

5. Subscriptions and Payments

FutWiser offers auto-renewable subscription plans to access premium features. By subscribing, you agree to the following terms:

Subscription Tiers:

Subscription Features:

• Basic: Ad-free experience, basic statistics (excluding corner/card data), access to all matches.
• Pro: All Basic features, daily AI-powered predictions, advanced AI analysis.
• Elite: All Pro features, corner and card statistics, VIP customer support.

Billing and Renewal:

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew at the end of each billing period (weekly, monthly, or yearly) unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• Prices are in EUR and may vary by region based on App Store or Google Play pricing.

Cancellation:

• You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.
• No refunds are provided for partial subscription periods.

Free Trial:

• If a free trial is offered, you will not be charged during the trial period.
• At the end of the free trial, the subscription will automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends.
• Any unused portion of a free trial is forfeited upon purchasing a subscription.

6. User Conduct

When using the App, you agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the App, servers, or databases.
• Reverse engineer, decompile, or disassemble any part of the App.
• Reproduce, distribute, or commercially exploit the App's content without permission.
• Use automated scripts or bots to access the App or extract data.
• Interfere with or disrupt the operation of the App or its infrastructure.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, data, software, and design — are the exclusive property of NORDIVUS OÜ or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Disclaimer of Warranties

The App and its content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee:

• The accuracy, completeness, or reliability of match predictions, statistics, or analysis.
• Uninterrupted or error-free operation of the App.
• That the App will meet your specific requirements or expectations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NORDIVUS OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Third-Party Services

The App may integrate with or contain links to third-party services (e.g., RevenueCat, Firebase, Apple App Store, Google Play Store). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is subject to their respective terms and policies.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Estonia.
